Introduction
These Terms and Conditions (“Terms”) govern your use of the MP Irrigation website and your purchase or use of services provided by MP Irrigation LLC (“MP Irrigation,” “we,” “our,” or “us”).
By using our website, submitting a service request, scheduling an appointment, making a payment, or accepting our services, you agree to these Terms.
You must be at least 18 years old or otherwise legally authorized to enter into an agreement for the property receiving service.
Services
MP Irrigation provides sprinkler-system installation, startup, repair, maintenance, winterization, aeration, overseeding, and related property services.
The specific services included in your purchase will be stated on the applicable checkout page, estimate, invoice, work order, or written agreement.
Unless expressly included in writing, the purchase of one service does not include troubleshooting, repair work, replacement parts, system modifications, landscaping restoration, or additional visits.
Customer Information
You agree to provide complete and accurate contact, property, irrigation-system, and payment information.
Pricing and scheduling may be based on information you provide, including:
- Service address and ZIP code
- Number of irrigation zones
- Property or lawn size
- Additional backflow devices, pumps, faucets, or outdoor fixtures
- Requested services
- Property-access instructions
- Known system defects or special conditions
If the information provided is inaccurate or incomplete, MP Irrigation may adjust the price, decline the work, or contact you for authorization before performing additional services.
Scheduling and Arrival Times
Appointment dates and service windows are estimates and are not guaranteed. Routes may be adjusted because of weather, traffic, equipment problems, emergencies, staffing, property conditions, or other circumstances outside our reasonable control.
We may contact you by telephone, email, or text message regarding scheduling and arrival information.
Unless MP Irrigation expressly confirms an exact appointment, service may be completed as part of a geographically organized route.
Property Access and Customer Responsibilities
You are responsible for providing safe and reasonable access to all areas and equipment required to perform the service.
Before our arrival, you agree to:
- Unlock gates and provide necessary access instructions
- Secure pets
- Remove items blocking the irrigation controller, shutoff, backflow device, valves, or service areas
- Clearly identify known system problems when requested
- Follow water-shutoff or system-preparation instructions provided by MP Irrigation
- Inform us of known hazards, underground systems, private utilities, invisible fences, drainage components, or unusual property conditions
You represent that you own the property or have permission from the property owner to authorize the requested work.
MP Irrigation may decline or discontinue work when conditions are unsafe, access is unavailable, animals are unsecured, or the requested work cannot reasonably be completed.
Winterization Services
Sprinkler winterization reduces the risk of freeze damage by removing water from accessible portions of the irrigation system using compressed air. Winterization cannot guarantee that every component will be completely free of water or protected from damage.
The customer remains responsible for protecting the irrigation system and property from freezing weather before and after service.
You are responsible for:
- Following all preparation and water-shutoff instructions
- Disclosing pumps, wells, additional backflows, outdoor showers, faucets, or other connected equipment
- Protecting components that cannot be accessed or winterized
- Taking appropriate precautions during early, sudden, or severe freezing conditions
- Repairing preexisting damage, leaks, failed valves, defective backflow devices, or improperly installed components
MP Irrigation is not responsible for freeze damage caused by preexisting conditions, undisclosed equipment, inaccessible components, improper system design, customer actions, water being restored after winterization, or failure to follow instructions.
Aeration and Overseeding
Aeration and overseeding results depend on weather, soil conditions, watering, seed germination, existing lawn health, pests, disease, traffic, and customer maintenance.
MP Irrigation does not guarantee seed germination, turf density, weed prevention, or a particular lawn appearance unless a specific written warranty states otherwise.
The customer is responsible for watering and maintaining the treated area according to the instructions provided.
Estimates and Additional Work
Estimates are based on the information and conditions reasonably known when the estimate is prepared.
Unexpected conditions—including hidden damage, buried obstructions, unmarked private utilities, inaccessible valves, defective wiring, unsuitable soil, or previously modified irrigation components—may require additional labor, materials, or equipment.
MP Irrigation will attempt to obtain authorization before performing work that materially exceeds the agreed scope. Emergency or minor work reasonably necessary to prevent damage or leave the system in a safe condition may be performed when immediate authorization cannot reasonably be obtained.
Prices and Payment
Prices are shown on the applicable checkout page, estimate, work order, or invoice. Applicable service-area charges, additional-zone charges, parts, taxes, and payment-processing fees may be added when disclosed before purchase.
Online payments may be processed by a third-party payment provider. You agree to provide current and accurate payment information and authorize the stated charge.
Any unpaid balance is due according to the applicable invoice or written agreement.
Refund and Cancellation Policy
Unless a different written policy is provided for a particular service, online service purchases and reserved appointments are nonrefundable.
Because purchases reserve seasonal scheduling capacity and route availability, refunds are not provided for:
- Customer cancellations
- Changes in personal plans
- Failure to provide property access
- Failure to complete required preparation
- Incorrect information supplied during checkout
- Duplicate service performed by another contractor
- Weather changes occurring after a properly completed service
- Services that cannot be completed because of unsafe or inaccessible conditions
MP Irrigation may, at its discretion, allow a payment to be applied toward a rescheduled appointment or another service. Any credit or rescheduling accommodation must be approved by MP Irrigation and does not create an obligation to provide the same accommodation in the future.
If MP Irrigation cancels a prepaid service and does not offer or complete a reasonable replacement appointment, the amount paid for the uncompleted service will be refunded.
Nothing in this section limits any refund or cancellation right that cannot legally be waived.
Missed Appointments and Return Visits
Additional charges may apply when a return visit is required because:
- Water was not shut off as instructed
- A gate or required area was inaccessible
- Pets were not secured
- Incorrect property or system information was provided
- The customer restored water or altered the system
- Additional equipment or zones were not disclosed
- Conditions prevented the scheduled service from being completed
Payment for a service does not guarantee that MP Irrigation can complete the work when the property is inaccessible or unsafe.
Existing Conditions and Damage
MP Irrigation is not responsible for preexisting defects, concealed damage, normal wear, improper installation, code violations, deteriorated components, brittle piping, defective wiring, or damage caused by other contractors, property owners, animals, weather, utilities, roots, soil movement, or circumstances outside our reasonable control.
Performing work on an existing system does not mean MP Irrigation accepts responsibility for the design, installation, performance, or condition of the entire system.
Underground Utilities and Private Lines
Public utility-location services may not mark privately installed lines or equipment. Unless specifically included in writing, the customer is responsible for identifying private electrical lines, irrigation piping, drainage systems, invisible fences, septic components, propane lines, landscape lighting, and similar underground items.
MP Irrigation is not responsible for damage to underground items that were not accurately marked or disclosed before work began, except to the extent responsibility cannot legally be excluded.
Website Information
We make reasonable efforts to keep website information accurate. However, website content may occasionally contain errors, outdated information, or technical problems.
We may change website content, pricing, service descriptions, availability, and these Terms at any time. Changes will not retroactively alter a written agreement for services already purchased unless required by law or agreed to by both parties.
Disclaimer of Warranties
Except for any written warranty specifically provided by MP Irrigation and any warranty that cannot legally be excluded, the website and services are provided on an “as available” basis.
We do not guarantee uninterrupted website access, exact scheduling times, particular landscaping results, or that an irrigation system will remain free from future leaks, failures, or freeze damage.
Limitation of Liability
To the fullest extent permitted by law, MP Irrigation will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the website or services.
MP Irrigation’s total liability relating to a particular service will not exceed the amount paid to MP Irrigation for that service.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
Indemnification
To the extent permitted by law, you agree to indemnify and hold MP Irrigation harmless from third-party claims arising from inaccurate information you provide, your lack of authority to approve work, undisclosed property hazards, or your failure to follow service and safety instructions.
Privacy
Your use of our website and services is also governed by the MP Irrigation Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles.
Any legal action arising from these Terms or MP Irrigation’s services must be brought in a court with proper jurisdiction in Rhode Island, unless applicable law requires otherwise.
Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
No Waiver
A failure by MP Irrigation to enforce a provision of these Terms does not waive our right to enforce that provision later.
Entire Agreement
These Terms, the applicable checkout page, accepted estimate, invoice, work order, Privacy Policy, and any written service agreement constitute the complete agreement concerning the purchased service.
If there is a conflict, a signed written agreement or accepted written estimate governing the specific work will control.
Changes to These Terms
We may update these Terms periodically. The updated version will be posted on our website with a revised effective date.
